Terms & License
Effective date: September 2026 · freakmaps.com
1. About This Site
FreakMaps (freakmaps.com) is an independent project built and maintained by Bartłomiej Banasik. It is an infrastructure visualization tool built on OpenStreetMap data — designed to show the bigger picture, not street-level detail.
By using this site, you agree to these Terms.
Paid passes are sold by the legal entity identified at checkout and on your invoice.
2. Data & Ownership
OpenStreetMap data
All geographic data comes from OpenStreetMap and is available under the Open Database License (ODbL). This data belongs to OSM contributors, not to this site.
Map data © OpenStreetMap contributors, available under the ODbL.
Original work
The following are the intellectual property of the site operator:
- Visual map styling and colour schemes
- User interface, layout, and design
- Data filtering logic and layer curation
- Site structure, copy, and presentation
These are not covered by the ODbL and are not freely licensed for reuse unless stated below.
3. User Accounts
You can create an account with Google Sign-In, Apple Sign-In, or with a one-time sign-in link or code sent to your email address. By creating an account, you agree to the following:
- You must be at least 13 years old (or the minimum age required by law in your jurisdiction) to create an account.
- You are responsible for maintaining the security of your sign-in credentials.
- You may only create one account per person. Duplicate accounts may be removed.
- You must not use your account for any illegal, abusive, or unauthorized purpose.
The site operator reserves the right to suspend or permanently terminate accounts that violate these Terms, without prior notice. Account data is stored and processed as described in the Privacy Policy. You may delete your account at any time from Settings → Account. Account-linked custom presets, checkout attempts, and active entitlements are deleted; minimal anonymized Stripe audit records may be retained for tax, accounting, dispute, refund, fraud-prevention, and legal compliance.
4. Paid Export & Customisation Pass
FreakMaps offers a paid Export & Customisation Pass. A pass is a one-time purchase, not a subscription. It unlocks custom map preset creation/editing/deletion and browser PNG export without the RailsMaps/FreakMaps brand watermark for the stated duration (for example 7 days, one calendar month, or one year), and it licenses the images you export for commercial use as set out below.
- Access starts after Stripe confirms payment and the webhook grants the entitlement. A successful redirect page alone does not grant access.
- One active pass unlocks the same paid export/customisation features on both FreakMaps and RailsMaps when you use the same shared account.
- Version 1 exports are browser-side PNG downloads only. No server rendering, guaranteed high-resolution export, queue, storage, or delivery service is included.
- Paid export removes only the site brand watermark. OpenStreetMap, MapLibre, Protomaps, and other required map/source attribution must remain visible and must not be removed or obscured.
- Refunds, disputes, chargebacks, suspected fraud, or payment reversals may immediately revoke access to the paid features. Unless stated otherwise, partial refunds may revoke the full remaining pass. This affects feature access only — images you already exported stay licensed under the licence below.
- Prices and available pass durations may change. A paid pass grants access only for the purchased duration and does not guarantee future features, uptime, or continued availability.
Commercial licence included with an active pass
While your pass is active, the images you export are licensed for commercial use by you or your organisation, including its affiliates and contractors acting on its behalf. This covers marketing materials, publications, presentations, websites, reports, packaging and print, worldwide and in any medium.
This licence is perpetual and irrevocable for images exported while the pass was active. When a pass expires you can no longer export new images, but everything you already exported stays licensed. Ending a pass — including through a refund, dispute or chargeback — removes feature access but does not revoke the licence for images already exported.
Not covered by the pass licence
- Reselling exported images as imagery — stock libraries, print or poster sales, map packs or similar
- Products where the map image itself is the primary value of what is being sold
- Distributing the exported image files as files, rather than as part of finished materials
- Any use that removes, crops or obscures the OpenStreetMap, MapLibre and Protomaps attribution baked into the export
These still require prior written permission. Contact: [email protected]
This licence covers the exported image and the cartography, styling and layer design of this site. It does not grant any rights over the underlying OpenStreetMap data itself, which remains available to everyone under the ODbL and which this site cannot grant or restrict. Required OpenStreetMap, MapLibre and Protomaps attribution stays part of the image in every use.
5. Right of Withdrawal and Refunds
If you are a consumer in the European Union or EEA, you normally have 14 days to withdraw from a distance purchase. A pass is digital content supplied immediately: by completing checkout and starting the pass you expressly ask for immediate performance and acknowledge that you lose the right of withdrawal once access has been granted.
That is the legal position, not the practical one. If a pass did not work as described, or you bought it by mistake, email the address in section 13 and it will be sorted out. Refunds are handled through Stripe to the original payment method.
This section applies to consumers. Purchases made by a business, or in the course of a trade or profession, are not covered by the statutory withdrawal right.
6. Permitted Uses
Non-commercial use — free, no pass or permission needed
You may use screenshots or map views for personal projects, enthusiast publications (print or digital), academic research, journalism, and non-profit content — provided you include this credit:
Map: freakmaps.com | Data: © OpenStreetMap contributors
For print, place the credit near the map image. For digital, a visible credit with a link is preferred.
Commercial use
Commercial use of exported images is covered by an active Export & Customisation Pass, under the licence in section 4. Without a pass — for example commercial use of plain screenshots — prior written permission is required, as are the uses excluded from the pass licence. Contact: [email protected]
7. What You Cannot Do
- Scrape or bulk-download tiles or data from these servers
- Point another site, application or service at these tile servers — the data is ODbL, but access to this infrastructure is not part of what is offered
- Automate or abuse browser exports, custom preset APIs, or checkout flows
- Resell exported images as imagery, or pass the exported files on as files, without prior written permission
- Use these maps in a way that implies official endorsement
- Remove or obscure attribution to OpenStreetMap contributors
- Claim the visual design or UI as your own work
8. Accuracy & Reliability
Maps are built on community-maintained OSM data. Quality varies by region and changes over time. Not suitable for navigation, safety-critical decisions, or legal purposes.
9. Liability
The site, the maps and the exports are provided as they are, without warranty of accuracy, completeness or fitness for a particular purpose. You are responsible for checking that a map is suitable before you rely on it or publish it.
To the extent permitted by law, total liability for any claim connected with the site or a pass is limited to the amount you paid in the twelve months before the claim arose, and there is no liability for indirect or consequential loss, lost profits, or loss of data. Nothing here excludes liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection rules.
10. Service Availability
This is a side project run by one person, with no guaranteed uptime or support. The service may change or shut down at any time without notice.
11. Governing Law
These Terms are governed by Polish law. If you are a consumer resident in another EU or EEA country, you keep the protection of any mandatory provisions of the law of your country of residence, and you may bring proceedings there. Disputes that cannot be resolved by agreement are subject to the courts having jurisdiction over the seat of the site operator.
12. Changes
These Terms may be updated at any time. The effective date at the top reflects the latest revision. Continued use constitutes acceptance.
